Consent to Electronic Delivery of Communications and Electronic Signatures

Scope of Consent

This Electronic Consent applies to all Communications (as hereinafter defined) related to any accounts, products, or services (the “Services”) provided to you by Cache Financials Inc. and its subsidiaries, Cache Advisors LLC and Cache Securities LLC (collectively or individually, “Cache”). This Electronic Consent shall supplement any other agreement or terms governing transactions, accounts or other matters pertaining to your relationship with Cache (each, a “related agreement”); provided,d however, that the terms of any related agreement shall supersede any conflicting terms of this Electronic Consent, solely with respect to matters related to this Electronic Consent.  

“Communications” includes, but is not limited to, all account statements, Cache Advisors LLC’s Form ADV and Form CRS, disclosures, privacy notices, regulatory communications, applications, authorizations, agreements, acknowledgements, Cache Advisors LLC’s Form ADV and Form CRS, and other notices, statements and communications delivered or provided by Cache in connection with the Services provided, or proposed to be provided, to you by Cache.  Communications may be provided via an online posting on Cache’s website or internet portal, e-mail, or other electronic means.

All Communications provided to you in any of the ways described in this Electronic Consent will constitute good and effective delivery of the Communications when sent or posted by Cache. To the extent required by law, Cache shall deliver information by sending you a notice, whether by e-mail or otherwise, that directs you to a website that contains the information and from which it can be read and printed. You agree that the sending of the notice by Cache will constitute good and effective delivery of the information to you, regardless of whether you actually access the website containing the information. If an applicable law requires paper copies to be provided, Cache will provide paper copies of such information required. You must provide Cache with a valid e-mail address and are required to notify Cache promptly using one of the methods in the Contact Information section below in the event your e-mail address changes or becomes inaccessible. 

Your consent to electronic delivery of Communications is effective immediately and will remain in effect unless and until either you or Cache revoke it. If you do not wish to use an electronic signature, you can contact Operations for more information. Note that Cache’s policy is to require electronic consent to the extent permissible by law.

By accepting this Electronic Consent, you also consent to the use of electronic signatures in place of handwritten signatures for each agreement entered into between you and Cache, as well as any document or consent that requires a signature from you.  You agree that any such electronic signature is valid as if it were signed in writing, and no certification authority or other third party verification is necessary to validate any electronic signature, and that the lack of such certification or third party verification will not in any way affect the enforceability of any such electronic signature.

Revocation of Consent

You may revoke this consent to electronic delivery at any time by notifying Cache using one of the methods in the Contact Information section below that you wish to receive future Communications in paper format. Such revocation shall include the address that you desire all information to be sent to and will be effective after Cache has had a reasonable time to act on such notice. There are no fees associated with the revocation of your consent; however, you may be required to pay a fee for the paper copy of Communications unless charging a fee is prohibited by applicable law. You agree that upon revocation, Cache may restrict or terminate your access to certain services or eliminate product features of your services where permissible by law.

The computer hardware and software used to access Cache’s website and this Electronic Consent are all you will need to access the Communications provided to you in electronic form. This includes the use of a standards-compliant web browser that supports HTTPS protocol, HTML, and the acceptance of cookies in your security settings. Viewing and retaining PDF documents may require additional software (available for free download), such as Adobe Acrobat Reader or a similar application.

By electronically indicating your acceptance of this Electronic Consent, you consent to receiving all Communications from Cache pursuant to this Electronic Consent and to the use of electronic signatures as described herein.
